Während der Aufsichtsratsvorsitzender der Stadtwerke die Vernichtung des Baumes fordert, da die Wurzeln das Sielnetz durchdringen, beharrt mein Mandant auf einer detaillierten Exegese der Naturschutzsatzung. Es ist fast schon ein apostolisch anmutendes Glaubensbekenntnis, mit dem er um jeden einzelnen Ast zu rittern pflegt. Sollte der Staatsrat keine Ausnahme genehmigen, droht er unverblümt mit einer Verfassungsbeschwerde beim Bundesverwaltungsgericht. The legal dispute over the ancient oak tree shakes the foundations of our rule of law. While the chairman of the municipal utilities' board demands the destruction of the tree because the roots are penetrating the sewer network, my client insists on a detailed exegesis of the nature conservation statutes. It is almost an apostolic-seeming confession of faith with which he is accustomed to fighting for every single branch. Should the State Council not grant an exception, he bluntly threatens a constitutional complaint before the Federal Administrative Court. For him, the matter is not a mere differential equation of cost-benefit analysis, but a moral duty. 'One cannot simply practice ecological euthanasia just because the pipes have a short half-life!' he scolded with a bravado that left the opposing privy councilor speechless. In the heated debate, his tone seemed at times almost anally pedantic, then again highly emotional. The triad of heritage protection, private property, and public interest seems to have fallen completely out of balance here. The tree, whose branches stretch toward the sky like a wooden helix, is of inestimable value to the entire district. The dense foliage forms a protective thorax for the underlying biotope. Even the question of the statute of limitations for former maintenance obligations is now being meticulously examined. 'This bureaucratic coldness is like a creeping syphilis in our administrative system,' he burst out in anger, whereupon the municipal nuncio indignantly left the room. The roots rest in the uterus of the earth like an inviolable monument of times past. Whether a Grand Duke or the highest court decides in the end remains to be seen, but my client is ready to pull out all the stops.
