The algorithmic analysis of the helix or the diagnosis of syphilis now occurs with a precision that poses completely new challenges to the rule of law. We must passionately fight for ethical sovereignty over interpretation before the half-life of our human empathy finally expires. When an AI judges anomalies in the thorax or the uterus, this is no mere technical confession of faith, but an act that, in extreme cases, can lead to a constitutional complaint. But what about the integrity of privacy when the machine even includes the most intimate behavioral patterns, such as masturbation or specific sexual practices like blowjobs or anal preferences, into its triad of risk assessment? Historically, medicine was often a tool of power that instrumentalized terms like indecency to control people in their respective parishes. We must never forget that the line between healing and the cruel euthanasia ideology of an extermination camp was often painfully thin in history. It is the duty of the legislator to ensure that algorithmic wrong decisions do not simply disappear behind a wall of the statute of limitations. AI must not become the infallible nuncio of a cold, data-driven world order that perceives the human being only as the sum of their biological data. We need a discourse that goes beyond the purely functional and defends the dignity of the individual against a purely computational logic.
